Getting an SR22 requirement as a rideshare driver creates a uniquely difficult situation. Here is the reality of what SR22 means for Uber and Lyft drivers — and what your options are.
Can You Drive for Uber or Lyft With SR22?
Technically SR22 itself does not prevent you from driving for Uber or Lyft. However the underlying violation that triggered your SR22 requirement almost certainly will.
Both Uber and Lyft conduct regular background checks and Motor Vehicle Record (MVR) checks on their drivers. A DUI conviction — the most common SR22 trigger — permanently disqualifies you from driving for Uber under their current policy. A DUI disqualifies you from Lyft for at least 7 years.
For less severe violations such as driving without insurance or accumulating too many points, the platforms may deactivate you temporarily rather than permanently. The specific consequences depend on the violation type, your state, and each platform’s current policy.
How Uber and Lyft Background Checks Work
Uber and Lyft use third-party background check providers that search both criminal records and motor vehicle records. These checks are run at the time of onboarding and periodically during active driver status — typically every year.
A DUI conviction appears on both your criminal record (if prosecuted as a misdemeanor or felony) and your driving record. Both types of records are checked. This means a DUI that triggers SR22 will almost certainly be discovered by the platform’s background check system regardless of when it occurred.
Less severe driving violations that trigger SR22 — driving without insurance, reckless driving, too many points — may or may not be disqualifying depending on the platform’s specific criteria and the number and recency of violations.
What Happens to Your Rideshare Account After a DUI
Uber’s current policy permanently disqualifies drivers with a DUI conviction within the past 7 years, and in many cases permanently. Once a DUI appears in your background check Uber will deactivate your account.
Lyft’s policy disqualifies drivers with any DUI conviction in the past 7 years. After 7 years, drivers may be eligible to reapply depending on their overall driving record and background.
Both platforms also require drivers to maintain a clean driving record throughout their active period. Even if you were already an active driver when the DUI occurred, a subsequent background check that reveals the conviction will trigger deactivation.
SR22 and Rideshare Insurance: The Coverage Gap Problem
For rideshare drivers who are not deactivated following a non-DUI SR22 violation, there is an important insurance issue to understand.
Standard personal auto insurance — including SR22-backed policies — typically excludes coverage during the period when you are logged into the rideshare app but have not yet accepted a ride (Period 1). Uber and Lyft provide limited liability coverage during Period 1, but this coverage may not satisfy your SR22 minimum requirements in all states.
When you have an active ride (Periods 2 and 3), Uber and Lyft provide $1 million in liability coverage which more than satisfies any SR22 minimum. But during the offline period and Period 1, your SR22-backed personal policy is your primary coverage.
Some insurers now offer rideshare endorsements that fill the Period 1 gap. If you are driving for rideshare while on SR22, ask your insurer specifically about rideshare coverage to ensure there are no gaps.
Alternative Income Options During SR22
If your rideshare account has been deactivated, here are realistic alternatives for gig income during your SR22 period.
Delivery driving — DoorDash, Instacart, Amazon Flex, and similar services — often have different and sometimes less strict background check requirements than passenger rideshare. Some delivery platforms may accept drivers with certain violations that would disqualify them from passenger rideshare.
Freelance skilled work that does not require driving — remote work, skilled trades, and other non-driving gig opportunities — may be a more viable path during the SR22 period.
The most important priority during SR22 is maintaining a completely clean driving record. Any additional violation during your SR22 period compounds your situation significantly for both insurance purposes and any future employment involving driving.
